Key: how to read this page

The Bill is shown clause by clause (then Schedule by Schedule). Where a clause or Schedule paragraph amends an existing Act, the affected provision is shown underneath in a shaded box, as it would read once the change is applied: insertions underlined, deletions struck through, pulled from legislation.gov.uk. A clause with no shaded box makes new law of its own rather than amending an existing Act. Text shown lightened and in italics is not yet in force.

An unofficial reading aid: always verify against the Bill and the legislation. Nothing here is legal advice.

Explanatory Notes · published by the Government with the Bill
71. Clause 4 provides that the practice and procedure for cases before the IIAA will be governed by a set of statutory Procedure Rules, made by the IIAA Procedure Rules Board. It sets out how those Rules are to be developed, including a requirement to consult with those it considers appropriate. The IIAA will have powers to lay the Rules through statutory instrument, as if it were a Minister of the Crown. The Rules will be subject to Parliamentary scrutiny under the negative procedure. 72. This safeguards the operational independence of the IIAA by placing control of its procedural framework in the hands of an independent Board, rather than Ministers. It mirrors the existing Tribunal Procedure Committee (although unlike that system, where the Lord Chancellor has a role in allowing/disallowing the Rules, no Minister will be required to agree the Rules). 73. Clause 4 also introduces Schedule 3 which makes further provision about the content of IIAA Procedure Rules.
