Key: how to read this page

The Bill is shown clause by clause (then Schedule by Schedule). Where a clause or Schedule paragraph amends an existing Act, the affected provision is shown underneath in a shaded box, as it would read once the change is applied: insertions underlined, deletions struck through, pulled from legislation.gov.uk. A clause with no shaded box makes new law of its own rather than amending an existing Act. Text shown lightened and in italics is not yet in force.

An unofficial reading aid: always verify against the Bill and the legislation. Nothing here is legal advice.

new law1 amendment
(1)If, in respect of proceedings before the IIAA, the IIAA considers that—
(a)a relevant participant has acted improperly, unreasonably or negligently, and
(b)as a result, the IIAA’s resources have been wasted,
it may charge the participant an amount under this section.
(2)Subsection (1) is subject to IIAA Procedure Rules (and see paragraph 16 of Schedule 3).
(3)For the purposes of this section “relevant participant”, in respect of proceedings, means—
(a)a party to the proceedings,
(b)a representative of a party to the proceedings, or
(c)an employee of such a representative.
(4)A person may be found to have acted improperly, unreasonably or negligently for the purposes of subsection (1) by reason of having failed to act in a particular way.
(5)The IIAA must pay any amounts it receives under this section into the Consolidated Fund.
Explanatory Notes · published by the Government with the Bill
84. This clause allows the IIAA to charge a relevant participant in proceedings where it considers that they have acted improperly, unreasonably or negligently, and that this has resulted in the IIAA’s resources being wasted. A relevant participant includes parties to proceedings, representatives of parties, and employees of representatives. Any money charged under this power must be paid into the Consolidated Fund. 85. This provides a proportionate mechanism for the IIAA to respond where poor conduct by a party or representative creates avoidable delay or unnecessary work, while leaving the detailed operation and safeguards to be set out by the IIAA Procedure Rules Board in its Procedure Rules.
